Advanced Cell Technology's Ethics Advisory Board has been called window dressing for a corporate marketing plan. But the scientists and managers have paid attention, and the lawyers have gone along.

We investigate the causal uncertainty surrounding the flash crash in the U.S. Treasury bond market on October 15, 2014, and the unresolved concern that no clear link has been identified between the start of the flash crash at 9:33 and the opening of the U.S. equity market at 9:30. We consider the contributory effect of mini flash crashes in equity markets, and find that the number of equity mini flash crashes in the three-minute window between market open and the Treasury (...) Flash Crash was 2.6 times larger than the number experienced in any other three-minute window in the prior ten weekdays. We argue that (a) this statistically significant finding suggests that mini flash crashes in equity markets both predicted and contributed to the October 2014 U.S. Treasury Bond Flash Crash, and (b) mini-flash crashes are important phenomena with negative externalities that deserve much greater scholarly attention. The participation of physicians in the atrocities of the Holocaust exposed vulnerabilities in medicine’s moral commitment to patients’ best interests that every health professional should recognize. Teaching about this history is challenging, as it is extremely complex and there are no common standards for what basic historical facts students in health professions training programs should learn. Nor is there guidance on how these historical facts can or should be related to contemporary ethical issues facing health professionals. To address these problems, (...) we propose a set of core historical facts about health professional involvement in the Holocaust that every student in a health professional training program should learn. We then identify three ethical lessons from the Holocaust that are pertinent today as physicians struggle to maintain their moral compass and earn the trust of patients and the public: 1) The lesson of commitment to science; maintaining balance between reason and skepticism in the search for truth, The lesson of clinical detachment; maintaining balance between necessary professional distance with a commitment to humanism and intimacy with patients, and 3) The lesson of competing loyalties; maintaining balance in upholding medicine’s multiple responsibilities, including to individual patients and the larger community. Embedding these facts and lessons into the education of health professionals is challenging yet critically important. Today’s physicians struggle with some of the same ethical tensions as did German physicians in the Nazi era, albeit in a much-attenuated fashion. Awareness of these tensions and taking active measures to maintain them in balance are necessary components of humanistic health care, which should be an integral part of health professional training programs. We use Homer and Sun Tzu as a background to better understand and reformulate confrontation, anger and violence in medicine, contrasting an unproductive ‘love of war’ with a productive ‘art of war’ or ‘art of strategy’. At first glance, it is a paradox that the healing art is not pacific, but riddled with militaristic language and practices. On closer inspection, we find good reasons for this cultural paradox yet regret its presence. Drawing on insights from Homer's The Iliad and The (...) Odyssey, we argue for better understanding of confrontation, anger, bullying, intimidation and violence in medicine in order to change the culture. For example, equating medicine with war is not a given condition of medicine but a convenient metaphor with historical origins and a historical trajectory. Other, non-martial metaphors, such as medicine as collaboration, may be more appropriate in an age of team-based care. Taking lessons from Homer, we suggest three key ways in which cold-hearted confrontation and anger in medicine can be transformed into productive, warm-hearted engagement: the transformation of angry impulse into reflection, moral courage and empathy. Thinking with Homer can offer an aesthetically and morally charged alternative to the current body of literature on topics, such as anger in doctors, and how this may be ‘managed’, without recourse to an instrumental economy where emotions are viewed as commodities, and emotional responses can be ‘trained’ through communication skills courses. The merit of Plato’s Laws remains largely untapped by those seeking genuinely collaborative models of the doctor–patient tie as alternatives to paternalism and autonomy. A persistent difficulty confronting proposed alternatives has been surpassing the notion of pronounced intellectual and values asymmetry favoring the doctor. Having discussed two prominent proposals, both of which evince marked paternalism, I argue that reflection on Plato yields four criteria that a genuinely collaborative model must meet and suggest how the Laws addresses them. In the process, (...) the Laws’ doctor–patient tie is shown to be far more nuanced than interpreters have previously observed. Although Plato’s account will not solve our own quandaries, it illustrates how one might retain asymmetry of a kind without capitulating to familiar oppositional modalities. Through this account, I hope to show that the Laws merits fuller inclusion in contemporary discussions than it has heretofore received. (shrink)

ABSTRACT Many philosophers who wish to defend abortion, but who have become frustrated by the resistance of the personhood question to yield to any nonarbitrary solution welcomed Judith Thomson's ‘A defense of abortion.’Thomson argues that abortion is sometimes justifiable even if the foetus is a person. In this paper I argue that Thomson's argument is a defense of abortion, rather than merely extraction without death, only because of the current state of medical technology. Once the technology is in place to (...) extract foetuses while preserving their lives and to allow them to develop to full term outside the uterus, Thomson cannot defend the killing of the foetus. If she is right, however, a woman will still have the right to have a foetus extracted from her body. Finally, it is pointed out that the source of the problem with Thomson's argument is the major premise in most arguments for the permissibility of abortion: a woman's right to control her own body. If the defence of abortion is to entail a defence of the termination of the foetus, then this premise, understood as the right to remove an unwanted entity from one's body or the right to alter one's body as one wishes, simply will not do the trick. In our essay ‘What’s Historical About Historical Materialism?’, we drew two contrasts between the Darwinian theory of evolution (ET) and the Marxist theory of historical materialism (HM).1 We described the former as a ‘micro-theory’ and the latter as a ‘macro-theory’. We also argued that, in Darwinian theory, evolution is driven by exogenous forces, specifically, by natural selection induced by environmental factors; whereas historical materialism sees the transformation of a society from feudalism to capitalism and then to socialism as a consequence (...) of an endogenous process, involving ‘contradictions’ between forces and relations of production and class struggle. Nolan has taken issue with both of these contrasts; his view is that the two theories are more similar than our account allows. (shrink)

Healing the Reason-Emotion Split draws on research from experimental psychology and neuroscience to dispel the myth that reason should be heralded above emotion. Arguing that reason and emotion mutually benefit our decision-making abilities, the book explores the idea that understanding this relationship could have long-term advantages for our management of society's biggest problems. Levine reviews how reason and emotion operated in historical movements such as the Enlightenment, Romanticism and 1960s' counterculture, to conclude that a successful society would restore human connection (...) and foster compassion in economics and politics by equally utilizing reason and emotion. Integrating discussion on classic and contemporary neurological studies and using allegory, the book lays out the potential for societal change through compassion, and would be of interest to psychologists concerned with social implications of their fields, philosophy students, social activists, and religious leaders. People typically show excellent memory for information that is central to an emotional event but poorer memory for peripheral details. Not all studies demonstrate memory narrowing as a result of emotion, however. Critically important emotional information is sometimes forgotten; seemingly peripheral details are sometimes preserved. To make sense of both the general pattern of findings that emotion leads to memory narrowing, and findings that violate this pattern, this review addresses mechanisms through which emotion enhances and impairs memory. Divergent approaches to (...) characterising information as central versus peripheral are also addressed. By directly contrasting these approaches, and the evidence supporting them, this review helps to clarify when and how emotion enhances memory and provides directions for future research. Evidence shows that memory narrowing as a result of emotion, and a number of violations of the memory narrowing pattern, can be explained by the view that emotion enhances memory for information relevant to currently active goals. This book explores an ethical value central to all mental health professions. Although "dignity" appears near the beginning of many codes of ethics, it has been largely unexamined in the professional literature. Potter Stewart famously declared about pornography that we can't define it but we know it when we see it. Likewise with dignity. This book addresses that gap. The book considers the role of dignity as an ethical dimension of practice: in individual psychotherapeutic and psychoanalytic work; in the therapeutic (...) community; and in groups, organizations and nations. It outlines dignity in individual development and families, the role of dignity violations in the understanding and treatment of trauma, and how dignity and its violations can be a powerful force in conflict resolution. The book will also address dignity in relations to specific populations, with chapters on the African-American and the LGBT experiences. Listening, with the question of dignity in mind, offers a fresh non-pathologizing framework for the practitioner. (shrink)

There is ample evidence that humans (and other primates) possess a knowledge instinct—a biologically driven impulse to make coherent sense of the world at the highest level possible. Yet behavioral decision-making data suggest a contrary biological drive to minimize cognitive effort by solving problems using simplifying heuristics. Individuals differ, and the same person varies over time, in the strength of the knowledge instinct. Neuroimaging studies suggest which brain regions might mediate the balance between knowledge expansion and heuristic simplification. One region (...) implicated in primary emotional experience is more activated in individuals who use primitive heuristics, whereas two areas of the cortex are more activated in individuals with a strong knowledge drive: one region implicated in detecting risk or conflict and another implicated in generating creative ideas. Knowledge maximization and effort minimization are both evolutionary adaptations, and both are valuable in different contexts. Effort minimization helps us make minor and routine decisions efficiently, whereas knowledge maximization connects us to the beautiful, to the sublime, and to our highest aspirations. We relate the opposition between the knowledge instinct and heuristics to the biblical story of the fall, and argue that the causal scientific worldview is mathematically equivalent to teleological arguments from final causes. Elements of a scientific program are formulated to address unresolved issues. (shrink)

The cognitive and behavioral functions of the frontal lobes have been of great interest to neuroscientists, neurologists, psychologists and psychiatrists. Recent technical advances have made it possible to trace their neuroanatomical connections more precisely and to conduct evoked potential and neuroimaging studies in patients. This book seeks to show how Karl Marx’s vision of communism was a continuation of Aristotle’s classical humanist philosophy. Challenging the Engelsian distortion of Marx, it presents a negation of previous interpretations of Marx which present him in materialist terms. Engels proposed a picture of the highest stage of communist society as an economic egalitarianism, a vision which became an axiom of Leninist-Stalinist-Soviet Communism. By contrast, here it is shown that Marx embraced the Aristotelian concept of “distributive justice”, of proportionate (...) equality. Spanning the works of Marx, from his university education and doctoral dissertation on the differences between the Democritean and Epicurean philosophy of the atom, to the study of his Rheinische Zeitung period and the persistence of classical humanism in Marx’s defense of the freedom of the press, Levine skillfully reveals the gravitational pull between Marx and Aristotle. Derrida’s “What is a ‘Relevant’ Translation?”, first delivered at the fifteenth annual Assises de la Traduction Littéraire à Arles in 1998, is an address that appears at first to speak from the outside and with a certain deference to professional translators. Yet, it quickly becomes apparent that Derrida not only counts himself among them but uses the occasion to reflect on his own surprising success as a translator of Hegel. This success has to do first and foremost with the proven (...) “relevance” of his translation of the notoriously untranslatable term Aufhebung as relève [in English: sublation]. Not a little perplexed by this apparent triumph, Derrida takes up the French term again, this time redeploying it in the translation of a crucial line from Shakespeare’s Merchant of Venice. In doing so, he relaunches his engagement with Hegel, asking what energies bound up in the concept of relève might yet be released, what internal resistances silently at work in it might still be mobilized to take it in an entirely new direction. Such an engagement enables him to explore in turn what resistances may be at work in the notion of translation itself. Inhabited by an internal otherness, by a constitutive resistance to itself, translation must be understood from the very first as transference. While translation studies have long been attentive to the transferential dynamics in which individual translators find themselves enmeshed, Derrida’s text views transference in more impersonal terms as the tenacious grip in which certain structures of thought hold us, structures which also inform our understanding of translation. How to work with and against this structural unconscious? To address this question, it is necessary to examine Derrida’s own translational practice and the privilege he accords to the term trouvaille. (shrink)

People may exhibit two kinds of modifications when demonstrating action for others: modifications to facilitate bottom‐up, or sensory‐based processing; and modifications to facilitate top‐down, or knowledge‐based processing. The current study examined actors' production of such modifications in action demonstrations for audiences that differed in their capacity for intentional reasoning. Actors' demonstrations of complex actions for a non‐anthropomorphic computer system and for people (adult and toddler) were compared. Evidence was found for greater highlighting of top‐down modifications in the demonstrations for the (...) human audiences versus the computer audience. Conversely, participants highlighted simple perceptual modifications for the computer audience, producing more punctuated and wider ranging motions. This study suggests that people consider differences in their audiences when demonstrating action. (shrink)

Discussions of immortality have tended to focus on the nature of personal identity and, in a related way, the mind/body problem. Who is that is going to survive, and is it possible to survive bodily destruction? There has been far less discussion of what immortality would be like; e.g. the nature of heaven. Richard Swinburne, however, has recently discussed ‘heaven’, and has constructed a novel theodicy fundamentally based on his conception of what heaven is like. I shall criticize both his (...) conception of heaven – a conception he claims is consonant with the classical theistic one of Aquinas – and also his theodicy. I will argue that his theodicy reintroduces the problem of evil in connection with his idea of heaven – and does nothing to resolve it. (shrink)

In keeping with other recent efforts, Fodor's CONCEPTS focuses on the metaphysics of conceptual content, bracketing such epistemological questions as, "How can we know the contents of our concepts?" Fodor's metaphysical account of concepts, called "informational atomism," stipulates that the contents of a subject's concepts are fixed by the nomological lockings between the subject and the world. After sketching Fodor's "what else?" argument in support of this view, we offer a number of related criticisms. All point to the same conclusion: (...) Fodor is ultimately not merely bracketing the epistemology of conceptual content; his theory makes answers to the epistemological questions impossible. (shrink)

In many spheres, the law takes the legal concept of causation to correspond to the folk concept (the correspondence assumption). Courts, including the US Supreme Court, tend to insist on the "common understanding" and that which is "natural to say" (Burrage v. United States) when it comes to expressions relating to causation, and frequently refuse to clarify the expression to juries. As recent work in psychology and experimental philosophy has uncovered, lay attributions of causation are susceptible to a great number (...) of unexpected factors, some of which seem rather peripheral to causation. One of those is the norm effect (Knobe & Fraser, 2008): Agents who, in acting as they do, break a salient norm, are more likely to be considered as having caused a certain consequence than when they do not violate a norm. According to some (e.g., Alicke, 1992) this constitutes a bias. According to others (e.g., Sytsma, 2020), the folk concept of causation is sensitive to normative factors, and there’s nothing wrong with that. In this paper, we explore the question whether the norm effect should be considered a bias from the legal perspective on the one hand, and from the psychological perspective on the other. To do this, we test whether norms which are nonpertinent to the consequences or outright silly also impact causation judgements. The data from two preregistered experiments (total N=593) clearly show they do. This, we argue, makes the bias interpretation plausible from the psychological perspective, and both plausible and problematic from the legal perspective. It also shows that the law should abstain from unreflectively assuming conceptual correspondence between legal and ordinary language concepts. (shrink)

Here, we revise Pietraszewski's model of groups by assigning participant pairs with two triplets, denoting: the type of game that models the interaction, its critical switching point between alternatives, and the perception of strategic similarity with the opponent. These triplets provide a set of primitives that accounts for individuals' strategic motivations and observed behaviors.

Harold Saxton Burr was a biologist working throughout the 1930s–1950s on an important set of problems related to biological organization and the origin of complex living forms. He was a profound thinker, suggesting a complementary focus on field concepts in addition to the emphasis on particle models and integrating concepts from physics and philosophy in his work. He developed innovations in electrophysiological technique and used them to perform a wide experimental survey of bioelectricity in normal and pathological growth. Here, I (...) briefly review his classic paper with philosopher F. S. C. Northrop, “The Electro-Dynamic Theory of Life,” in the context of advances in this field over the last few decades. Based on recent progress, it is now clear that Burr was a prescient and visionary thinker. His main hypothesis, that bioelectric gradients serve as prepatterns guiding morphogenesis, has been confirmed using modern molecular physiology, as have his ideas about the place of cancer and the nervous system in the question of biological organization. With limited technology but deep insight, he derived insights that anticipated many modern discoveries. Even more importantly, Burr’s view of bioelectricity as a convenient entry point for rigorous investigation of the broader question of self-organizing properties of life highlights a frontier of inquiry that awaits today’s researchers. Marx's Rebellion Against Lenin is a representative of the contemporary revitalization of the thought of Marx. It fulfils this task in three ways. First, it overthrows the dialectical materialism of Engels and of Stalinist Bolshevism by exploring 18th century historical thought and illustrating how these Enlightenment historians and political theorists first explored method of historical explanation that were later adopted by Marx. It is shown that contrary to the theory of Stalinist Bolshevism, Hegel was a vital influence on Marx. Second, (...) Levine's book represents Marx as an exponent of Classical Humanism. Marx did not define communism as a form of materialism, as economic egalitarianism, but rather related communism to the Classical ethics of Aristotle, to the Aristotelian ideas of polis citizenship and the ethics of distributive justice. Third, it is argued that the 17th and 18th Century Enlightenment was not simply a liberal center extolling property, individual rights and capitalism. Instead it is shown that the 17th and 18th century Enlightenment was divided between an Enlightenment Center and an Enlightenment Left, with the Enlightenment Left challenging the domination of capitalism and private property. Marx's Rebellion Against Lenin traces the flow of the theories of the Enlightenment Left into Marx and in doing so liberates Marxist thought from its imprisonment in 19th century materialism and relocates it within the traditions of Classical Humanism. In this article, we review approaches to modeling a connection between spatial and mathematical thinking across development. We critically evaluate the strengths and weaknesses of factor analyses, meta-analyses, and experimental literatures. We examine those studies that set out to describe the nature and number of spatial and mathematical skills and specific connections between these abilities, especially those that included children as participants. We also find evidence of strong spatial-mathematical connections and transfer from spatial interventions to mathematical understanding. Finally, we map (...) out the kinds of studies that could enhance our understanding of the mechanisms by which spatial and mathematical processing are connected and the principles by which mathematical outcomes could be enhanced through spatial training in educational settings. David Michael Levin's ongoing exploration of the moral character and enlightenment-potential of vision takes a new direction in The Philosopher's Gaze . Levin examines texts by Descartes, Husserl, Wittgenstein, Nietzsche, Heidegger, Benjamin, Merleau-Ponty, and Levinas, using our culturally dominant mode of perception and the philosophical discourse it has generated as the site for his critical reflections on the moral culture in which we are living. In Levin's view, all these philosophers attempted to understand, one way or another, (...) the distinctive pathologies of the modern age. But every one also attempted to envision--if only through the faintest of traces, traces of mutual recognition, traces of another way of looking and seeing--the prospects for a radically different lifeworld. The world, after all, inevitably reflects back to us the character, the reach and range, of our vision. In these provocative essays, the author draws on the language of hermeneutical phenomenology and at the same time refines phenomenology itself as a method of working with our experience and thinking critically about the culture in which we live. Metaphors of positions, spectrums, perspectives, viewpoints, and polarization reflect the same model, which treats beliefs—and the people who hold them—as points in space. This model is deeply rooted in quantitative research methods and influential traditions of Continental philosophy, and it is evident in some qualitative research. It can suggest that deliberation is difficult and rare because many people are located far apart ideologically, and their respective positions can be explained as dependent variables of factors like personality, partisanship, and demographics. An (...) alternative model treats a given person’s beliefs as connected by reasons to form networks. People disclose the connections among their respective beliefs when they discuss issues. This model offers insights about specific cases, such as discussions conducted on two US college campuses, which are represented here as belief-networks. The model also supports a more optimistic view of the public’s capacity to deliberate. (shrink)
